1. Acceptance of Terms
By accessing and using the ASPR app, website, or other services, users agree to comply with and be bound by these Terms and Conditions.
2. Eligibility and Accounts
- Users must provide accurate information when creating accounts. Accuracy of details is crucial in the event of a real Active Threat, and is shared with emergency response units and school/organization admin.
- School/organization administrators are responsible for managing staff/student accounts. This includes approving new student and faculty accounts.
- Users under 18 must have consent from a parent, guardian, or authorized school administrator.
3. App Usage
- The app is intended for safety, emergency response, communications, and drill coordination.
- Users must not misuse the app for unauthorized alerts, false reports, or any unlawful activity. All users can report and activate the "Panic Response" button. This is the equivalent of dialing 9-1-1 and any misuse or abuse may incur legal charges or other legal actions.
- Each organization must keep information (contact details, rosters) current for accurate operation.
4. Limitation of Liability
Exclusion of Liability
To the maximum extent permitted by applicable law, by using ASPR Corp services you agree that ASPR Corp., its affiliates, officers, employees, and agents shall not be liable for any criminal claims, monetary damages, losses, penalties, or legal actions arising from use or misuse of the app, technical failures, missed alerts, or emergency events. This includes, but is not limited to - indirect, incidental, consequential, exemplary, or punitive damages, and any financial or legal outcomes stemming from emergency response or decision-making made with the app.
No action arising out of use of ASPR Corp services may be brought against ASPR Corp for criminal findings, monetary damages, or other liabilities except where directly caused by ASPR Corp’s gross negligence or intentional misconduct (where such limitations are allowed by law). - ASPR Corp. provides tools to assist in emergency response but is not liable for missed alerts, technical failures, network outages, or any damages resulting from use or inability to use the app.
- The app is designed to streamline emergency response services, while accurately tracking an 'Active Threat' and ensuring user safety by requiring check-ins and self reports. Unfortunately, with any technology lies the potential for misuse/abuse, network outages, and other issues that can impact the availability and accuracy of the services provided. ASPR Corp. endeavors to minimize such risks through ongoing testing and monitoring; however, no guarantee of uninterrupted service or accuracy can be made. Remember - calling 9-1-1 if and whenever possible will always be the first preferred choice.
- The app does not replace official emergency services or procedures; always follow local protocols and regulations.
